A former Albany nursing home employee has been sentenced to 10 days in jail and a $300 fine as a result of an incident last September at Mother of Mercy Campus Care in which she was accused of placing a pillow over the head of a resident and holding it there for 10-15 seconds. 27-year old Tammy Marie Gilbert was convicted of a gross misdemeanor for mistreatment of residents or patients after entering an Alford plea. An Alford plea does not admit guilt but acknowledges there is enough evidence that it is likely a jury would find her guilty. Gilbert will get credit for one day of time served and can complete the remaining nine days through community service work in lieu of returning to jail. The nursing home was not fined or ordered to take any corrective action as a result of the Minnesota Department of Health investigation.
