The city of Cold Spring’s insurance provider has paid $7,500 to former police chief candidate Eric Johnson to settle his lawsuit against the city. The city’s insurer has waived its request for costs in the case, and Johnson has waived his right to pursue either post-trial motions or an appeal. The payment ends a legal battle that lasted 19 months and included a jury verdict for Johnson of $76,966 that later was overturned by the trial judge. Johnson sued the city in May 2014, accusing it of breach of contract and four other claims for offering him the police chief’s job and then reneging on the offer. Stearns County District Court Judge John Scherer dismissed three of the claims before trial and entered judgment in favor of the city on a fourth claim during a trial in August. A jury found for Johnson on the remaining claim of promissory estoppel. That claim alleged that the city promised Johnson the police chief’s job, that he relied on that promise to quit his job as Minneota police chief and that his reliance on Cold Spring’s offer was to his detriment when he was not hired.
