Federal judge denies request from a Stearns County man to withdraw his guilty plea

A federal judge Monday denied a request from a Stearns County man to withdraw his guilty plea to a charge that accused him of sending a threatening communication as part of an effort to hire someone to harm the fiancé of a former mistress. 30-year old Robert James Schueller previously pleaded guilty to one count of transmitting threats by interstate communication. His attorney cited a Supreme Court decision issued six days after Schueller’s guilty plea that changed what constitutes a violation of the statute Schueller pleaded guilty to violating. No sentencing date has been set.
