25-year-old Kyle St. Martin-Smith of Cushing has been found to be in violation of conditions of release from jail after multiple failed drug tests. St. Martin-Smith has been charged with one felony count each of first-degree attempted murder, first-degree assault and second degree assault in connection to a May 26th incident. St. Martin-Smith allegedly attacked Little Falls resident Ryan Deters with a baseball bat and a gun as well as threatened his life and the life of Deters’ mother. Assistant County Attorney Todd Kosovich said the defendant’s most recent drug test came back clean; however, a previous hair follicle test came back positive for heroin use. The hair follicle test was ordered after St. Martin-Smith requested alternate options for drug testing requirements, as the testing schedule was interfering with his ability to work. St. Martin-Smith is self-employed at a tree trimming company he owns and operates out of Randall. In an evidentiary hearing Monday, Judge Douglas Anderson ruled that as a result of the failed tests, St. Martin Smith must undergo a chemical dependency evaluation, known as a Rule 25 Assessment, and follow all recommendations of that assessment as an additional condition of his release. St. Martin-Smith was released after posting bail June 3, but could face additional jail time if those conditions continue to be unmet. Other conditions of St. Martin-Smith’s release include no contact, direct or indirect with either the victim or the victim’s mother, no drug or alcohol use and random drug testing. St. Martin-Smith is next scheduled to appear in court for a omnibus hearing on September 8th.
