–The Minnesota Supreme Court upheld the two counts of 1st degree murder conviction of 67-year old Byron Smith Wednesday morning. Smith was convicted by a Morrison County Jury in April 2014 and was sentenced to life in prison without the possibility of parole for shooting two teens who broke into his home Thanksgiving 2012. According to the Minnesota Supreme Court: 1) The district court did not err in denying the defendant’s motion to dismiss the indictment based on five separate, individually alleged errors. 2) The cumulative effect of the five alleged errors in the indictment process did not deprive the defendant of a fair grand-jury proceeding. 3) The nonpublic proceeding to discuss the district court’s ruling on a pretrial evidentiary issue did not violate the defendant’s Sixth Amendment right to a public trial. 4) The district court did not violate the defendant’s constitutional right to present a complete defense by excluding four pieces of evidence. 5) Because the prosecutor did not commit misconduct in closing argument, the district court did not err in failing to give a curative jury instruction. 6) The district court erred when it determined that the defendant’s restitution affidavit was timely. That means the district court should not have allowed Smith to challenge a restitution request to cover the cost of headstones for Haile Kifer and Nick Brady. Smith did not submit his challenge to the restitution amount on time, so the Supreme Court ordered the district court to award restitution of nearly $19,500 for the two headstones.

–Brainerd High School graduate 23-year old Josh Archibald made his NHL debut last weekend. The former Warriors standout was called up from the AHL to play a game last Saturday with the Pittsburgh Penguins. He wore #45 in a 4-2 loss to Calgary.

–Morrison County announced they will implement a permit process for placement of manure force main when in county road right of ways. During the recent legislative session a new provision was added to a Minnesota statue, authorizing road authorities to permit the placement of pressurized flexible force main used for the transport of manure for field application within its right of way. The applicant must be a property owner or occupant of property abutting the road right of way. No pumping equipment is allowed in the right of way. The road authority can also establish other terms and conditions that need to be met as part of the permit. Property owners or occupants of property who will be utilizing a force main to transport in Morrison County can contact the Morrison County Public Works office at 632-0121 for an application to permit this use.

–Jury trials are later this month for two accused of link to drug sales at Brainerd High School. 26-year-old Cassandra Kruger and 21-year-old Gabriel Chips both of Brainerd were in court on charges of selling or distributing a variety of illegal substances and including the employing of juveniles to sell synthentic drugs to students at the high school where the students who received them were suspended. Both Chips and Kruger face five felony counts and both have multiple criminal convictions in the past. Both are currently in the Crow Wing County jail awaiting their trials.

–A grease fire got out of control Tuesday morning at a home in Crosby. The fire department said a grease fire started and the homeowner attempted to put it out with a garden hose but that caused the fire to spread into the kitchen walls of the home on the 29000 block of Highway 6. The home sustained extensive smoke damage to the kitchen and the attic. Both was still ruled livable by the fire department. No one was injured in the fire. The fire department reminds the public not to put out grease fires with water.

–A 3-year-old sustained a back injury following a collision on Business Highway 371 near Brainerd Monday around 5:00pm. 43-year old Katrina Fitch of Brainerd was stopped at a stop sign when her vehicle was rear ended by 56-year-old Lou Pickar of Brainerd. Neither driver was hurt. 3-year-old Ella Mae Fitch was reportedly taken by private vehicle to the area hospital for treatment.
