Judge rejects plea deal for St. Cloud man in overdose case

The scheduled sentencing of a man who pleaded guilty to sharing crack cocaine with a woman who later died from an overdose didn’t happen when the judge rejected the plea agreement. 59-year old Marvin Davis pleaded guilty to second-degree manslaughter and was scheduled to be sentenced this month by Benton County District Court Judge Robert Raupp. But Raupp didn’t accept the terms of the plea agreement, which called for a sentence of about the amount of time that Davis has been in custody since his arrest late last year. The case against Davis essentially reverts back to the original charges against him — third-degree murder and a third-degree controlled substance crime. He is scheduled to go to trial November 2nd. Davis is accused of providing crack cocaine to 32-year old Shiquita Clark who died in early September at Davis’ east St. Cloud apartment.
